Privacy Notice for Parents

Privacy Statement

The American School Foundation of Guadalajara, A.C., hereinafter referred to as The American School, located at Colomos 2300, Col. Italia Providencia, Guadalajara, Jalisco CP 44630, is responsible for the personal information it collects through electronic, audio and personal means. It is committed to adhering to the regulations under the Protection of Personal Information in Custody of Organizations Law (FPDPPP).

Contact Information

The American School has named a multidisciplinary committee within its organization to manage the protection of personal data. This committee is responsible for the compliance and enforcement of the Protection of Personal Information in Custody of Organizations Law. It is designed to process any requests to limit the amount of information or its disclosure, as well as answer any questions or inquiries.

The American School has established administrative, technical and standard procedures in order to ensure the quality of personal information that it requests from individuals. It has taken into account the risks involved, the penalties for security violations, the nature of the information requested, as well as the technological implications. The personal data that The American School manages can be divided in to two sections: an individual with an academic connection to the school and an individual with an employment connection to the school. The following privacy agreement pertains to individuals with an academic connection to the school.

Individuals with an Academic Connection to The American School

Types of Personal Information

The American School collects data such as contact, identification, work history and income information in a lawful manner unless prohibited to do so by the parties involved. The individual with an academic connection to the school has the right to deny the collection of such data by means of a verbal or written refusal to the multidisciplinary committee aforementioned.

According to articles 40, 41 and 42 of the law, these types of information are used to establish a legal relationship with the school. These procedures include: the admissions process, collection of tuition payments, the administration of educational services, mandatory educational policy procedures, access-control for the operating systems, and to secure the internal safety of The American School.

Transfer of Information

The types of information mentioned in the section above can also be transferred to a third party. The objectives for such transfer of information are mentioned in article 37 of the law and 26 of the regulations are outlined in the Secretaría de Economía privacy notice.

The section titled, "Channels of Communication" details the process needed to inform The American School of the refusal to supply personal information. Individuals with an academic connection to the school have the right to request a report on the handling of their personal information according to the ARCO process mentioned in a latter section.

A report on the handling of information in relation to third parties may also be provided by request within the ARCO petition framework.

Sensitive Personal Information

The American School collects sensitive information such as: current health status, allergies, drug use, religious affiliation, illnesses, lifestyle, information regarding court proceedings, mental health information, information regarding underage children, ethnic background, community organization affiliations, blood type, and vaccinations.

According to the law, articles 40, 41 and 42 stipulate that this personal information may be used for the following academic procedures: the admission process, the administration of educational services, to fulfill mandatory educational procedures, secure the internal safety of the organization, and offer school medical services.

Transfer of Sensitive Personal Information

The types of sensitive personal information described above may be transferred and handled by a third party. The objectives for such transfer of information are mentioned in article 37 of the law and 26 of the regulations are outlined in the Secretaría de Economía privacy notice.

Retention Period

The American School will cancel and/or destroy personal information after it has served its purpose. It will block impertinent information during its use if its use does not align with the objectives previously outlined. The cancellation of personal information will not take place if it is prohibited to do so under the articles 26 and 34 of the law.

ARCO Rights

The American School will gladly follow through any requests that it receives from an individual or his legal representative to exercise their rights of access, correction, cancellation and objection of personal data under the terms and conditions set out in ARCO.

In order to submit a request, it is necessary to do so through an electronic or hardcopy document and through the means detailed in the "Channels of Communication" section of this privacy notice. Please include the following information:

  • Name and address, as well as contact information.

  • Proof of ID

  • A clear and detailed description of the rights the user wishes to exercise, as well as the personal data involved.

  • In case of a correction of personal information, provide the paperwork needed to support the request.

The response to the request will be supplied during the timeframe allowed by the law and as long as it does not apply to the exceptions found in the articles 26 and 75 of the regulations.

Consent Withdrawal

According to article 21 of the law, the user has the right to withdraw consent to the use of his or her personal information at any time. In order to stop the use and transfer of information, it is necessary to follow the guidelines detailed in this document.

When submitting the request according to the procedures mentioned, please include the following:

  • Name and address, as well as contact information.

  • Proof of ID.

Privacy Notice Adjustments

At The American School, we reserve the right to make adjustments or updates to our current privacy notice to align with new legislation, internal policies, or amendments.

These adjustments will be available for the public through the means described in the section "ASFG Privacy Statement and Channels of Communication", or at our website, www.asfg.mx.
